1) Overview

By accessing factoryse.co.in or purchasing from FactorySe, you agree to these Terms of Service (“Terms”) and to the policies linked in our footer (Shipping, Refunds & Returns, Cancellation, Privacy). We may update these Terms at any time by posting a new version here; continued use constitutes acceptance. Our store is hosted on Shopify, which provides the e-commerce platform we use to sell our products.

2) Eligibility & Account

You confirm you’re legally capable of forming a contract under Indian law. Keep your account credentials confidential and ensure your profile, shipping, and contact details are accurate and up to date.

3) Orders, Acceptance & Availability

Your order is an offer to buy; we accept only when we dispatch the product(s) and share tracking details. We may cancel or limit orders (e.g., suspected fraud/abuse, bulk reseller activity, stock or pricing errors). If we cancel after payment, we’ll refund the amount paid.

4) Pricing, Taxes & Promotions

Prices shown are inclusive of applicable taxes (GST). From time to time, we may run promotions (e.g., extra 10% off on prepaid payments); such offers are not valid on COD and may have caps, exclusions, and time limits. See any offer-specific terms shown on-site.

Prepaid Offer (illustrative): Extra 10% off on UPI/cards (auto-applied or via code), not valid on COD/gift cards; max discount ₹999 cannot be clubbed with other offers; we may modify or withdraw without notice.

5) Payments

We accept UPI, cards, net-banking, wallets, and Cash on Delivery (COD) for eligible pincodes. We may verify COD orders by WhatsApp/IVR/OTP and cancel unverified orders. Payments are processed by third-party gateways (e.g., Razorpay/Shopify Payments integrations). If a payment fails but funds are debited, your bank/gateway typically reverses it automatically.

6) Shipping & Delivery (India)

  • Processing & Dispatch: Usually 0-2 business days.

  • Transit Time: Typically 2–7 business days post-dispatch, depending on pincode/courier network.

  • Shipping Fees: Free shipping ≥ ₹799; ₹79 for orders below ₹799.

  • Coverage: India only (no international shipping).
    Timelines are estimates; courier delays can occur. Tracking is sent via email/SMS when shipped.

7) Returns, Replacements & Cancellations

  • Return window (damage/defect/wrong item): Inform us within 48 hours of delivery with a continuous unboxing video showing the package and product condition from opening to inspection. Requests without this evidence or raised after 48 hours may be declined.

  • Condition: Item must be unused, with all tags/accessories/manuals and original packaging.

  • Not returnable (unless DOA/defect on arrival): hygiene-sensitive categories (e.g., innerwear, personal care/beauty), consumables, custom/engraved items.

  • Method & costs: We arrange reverse pickup where available or ask you to self-ship. Return shipping is customer-borne unless our error is confirmed (damaged/defective/wrong item).

  • Inspection & resolution: Allow up to 7 business days from receipt for quality check; resolution may be replacement (stock permitting), store credit, or refund to original method.

  • Cancellations: You may cancel before dispatch by contacting support; once dispatched, see this Returns section.

  • RTO/refused deliveries/incorrect address: If a shipment returns due to refusal/incorrect address/unreachable recipient, we may deduct two-way shipping plus up to 10% restocking from any refund.

8) Product Information & Use

We curate products sourced directly from manufacturers and trusted partners, and aim for accurate titles/specs/images. Minor colour or packaging variations may occur. Follow all safety and usage guidelines; misuse or unauthorised repairs void any support we can offer.

9) User Content & Reviews

If you post reviews/photos/videos or submit content to us, you grant FactorySe a non-exclusive, royalty-free licence to use, reproduce, display, and share such content on our channels, provided it doesn’t infringe third-party rights or the law. We may moderate or remove unlawful or inappropriate content. (factoryse.co.in)

10) Prohibited Uses

Do not use the site for unlawful activity; do not submit malware, infringing content, deceptive information, or attempt to bypass security. We may suspend or terminate access for violations. 

11) Third-Party Services

We rely on third-party providers (Shopify, payment gateways, logistics, communications, analytics). Your use of any third-party service may be subject to their terms/policies; we are not responsible for third-party websites or services. 

12) Privacy & Data Protection (India)

Your personal data is processed per our Privacy Policy (see footer), which reflects applicable Indian law, including the Digital Personal Data Protection Act, 2023 (as and when operative/implemented through notified rules). You may have rights to access, correct, delete, or object to certain processing. Contact our Grievance Officer for concerns legal@factoryse.co.in .

13) Warranties & Liability

Except as required by law or expressly stated by us, the website and products are provided “as is” and “as available.” To the maximum extent permitted by law, we disclaim implied warranties (merchantability/fitness/non-infringement) and exclude liability for indirect or consequential losses. Our total liability for any claim is limited to the amount you paid for the product giving rise to the claim. (This section mirrors common Shopify ToS patterns.) 

14) Indemnity

You agree to indemnify and hold harmless FactorySe/Giftika Technologies Pvt Ltd and our officers, employees, partners, and service providers from claims arising out of your breach of these Terms or violation of law/third-party rights. 

15) Governing Law & Dispute Resolution

These Terms are governed by the laws of India. Subject to applicable consumer-protection law, the courts at Kochi, Kerala shall have exclusive jurisdiction over disputes.
